Freshmen Parking Rules and Regulations for Conditional License Agreement to Park

  1. Subject to the terms and conditions of the Conditional License Agreement to Park ("Agreement") and upon issuance of a parking pass, Freshmen Lots LLC grants the undersigned ("Parking Tenant") a conditional license to park one (1) motor vehicle in one (1) unreserved available parking space in a FreshmenLots LLC parking facility, in common with other licensed Parking Tenants, in accordance with these Rules and Regulations.

  2. Both parties expressly agree that the conditional license in no case creates the relationship of bailor and bailee between Freshmen Lots LLC and Parking Tenant.

  3. This conditional license shall only be valid for the period set forth in the Agreement. This conditional license to park is non-transferable and may not be assigned. The conditional license is non-refundable except for the provision noted below in paragraph eleven (11).

  4. A parking pass will be provided for parking access when this form and all required documentation is submitted and when payment is received for the covered period.

  5. The parking pass must be visible to Freshmen Lots LLC employees at all times. The parking pass is non transferrable. Freshmen Lots LLC is not responsible for lost or misplaced parking passes. In the case that the Parking Tenant loses his/her parking pass, he/she will need to pay $25 for a new parking pass.

  6. Any violation of the Agreement or these Rules and Regulations shall require a return of the parking pass and the conditional license to park shall be immediately revoked without prior notice.

  7. Parking outside of marked spaces is prohibited. Parking is for normal passenger vehicles only, including pick-up trucks and passenger vans. The parties agree that Freshmen Lots LLC shall have the right, without further notice to Parking Tenant to have towed any vehicle that is parked in the parking facility in violation of these Rules and Regulations or in violation of any posted signs. Parking Tenant shall not: Park on sidewalk or lawn/grass or other areas deemed not to be a marked parking location; block entrance, exit, or traffic within property; block another vehicle; double park or occupy more than one parking space; park without a valid permit; park with a duplicate, fake, or altered permit/temporary permit; transfer parking permit to another vehicle; or abandon their vehicle in the parking lot. Should Parking Tenant violate any of those items, Parking Tenant will be towed at his/her own expense. 

  8. The parking facility is a self-park facility. Parking Tenant affirms his/her understanding that Freshmen Lots LLC does not furnish attendants for the parking of automobiles, and if any employee, agent, or contractor of Freshmen Lots LLC or any other individual shall, at the request of Parking Tenant, handle, move, park or drive any vehicle placed in the parking facility, then such employee, agent, contractor, or individual shall be deemed the agent of Parking Tenant, and Freshmen Lots LLC shall not be liable for any loss, damage, injury or expense that may be suffered or sustained in connection with or arising from the acts of Parking Tenant or any individual who may be acting as the agent of Parking Tenant.

  9. Freshmen Lots LLC will use its best efforts to monitor the parking lot to ensure parking availability, a limited number of spaces will be made available to all registered Parking Tenants within their chosen lot (specified during registration). Freshmen Lots LLC will not furnish decals or make registration available above the pre-determined availability of spaces for each specific lot. Freshmen Lots LLC shall in no manner be obligated to provide any particular parking space to a single Tenant within those set number of reserved spaces.

  10. Freshmen Lots LLC reserves the right to close any parking facility for repairs and maintenance. When closing any parking facility, Freshmen Lots LLC shall seek to avoid any inconveniences to customers. No refunds will be given if this right is exercised.

  11. In the event that Freshmen Lots LLC is unable to provide its parking facilities, due to government regulation, natural causes, or for any other reason, Freshmen Lots LLC reserves the right to immediately terminate the Agreement and provide a pro rata refund to Parking Tenant without breach of the Agreement and without further liability to Freshmen Lots LLC.

  12. Freshmen Lots LLC reserves the right to refuse sale or issuance of a parking pass to any person who willfully refuses to comply with the Rules and Regulations of the Conditional License Agreement to Park.

  13. Articles left in vehicles are at the vehicle owner's risk. Freshmen Lots LLC is not responsible for items left in any vehicle parked in the parking lot.  Parking Tenant understands and expressly agrees that Freshmen Lots LLC does not assume, care, custody or control of any vehicle or its contents and will not accept the vehicle in bailment or for safekeeping; nor shall Freshmen Lots LLC be responsible for any loss or damage to any vehicle or its contents by fire, vandalism, theft, damage, loss, or any other cause to any private property on the premises including loss to vehicles or their contents. Nor shall Freshmen Lots LLC be responsible for any for loss, damage or injury of any nature by or to Parking Tenant or any other individual. Parking Tenant expressly acknowledges that Freshmen Lots LLC shall have no duty to provide security, and expressly does not assume any obligation to provide for the security of any parking facility or to protect individuals using any parking facility, or vehicles or property in the parking facility, from criminal or harassing activities.

  14. Parking Tenant understands that the parking lot is located off campus and that Freshmen Lots LLC is not affiliated with JMU. 

  15. If classes are moved online for any portion of the semester for any reason, Freshmen Lots LLC will not issue a refund to Parking Tenant.

  16. Freshmen Lots LLC reserves the right to eject or cause to be ejected from any of its parking facilities any person engaging in or conducting him/herself in a manner disruptive, abusive or offensive to other patrons at the parking facility. Neither Freshmen Lots LLC, nor any of its officers, agents or employees shall be liable to Parking Tenant for any damages that may be sustained by Parking Tenant through the exercise of such right. Parking Tenant will not leave trash or any other debris in the parking lot. If Parking Tenant is caught leaving trash in the parking lot, he or she will be banned from the lot and no refund will be given.

Parking Tenant assume all risks in entering and using the Freshmen Lots LLC parking facilities and hereby agrees to indemnify, defend and hold Freshmen Lots LLC and its employees, agents, and contractors free and harmless from and against any and all claims, actions, lawsuits, liabilities, costs and expenses (including reasonable attorney's fees and court costs) whatsoever arising out of or in any way connected with the grant of a parking pass, the Agreement, or the use, occupancy, maintenance, or control of the premises of Freshmen Lots LLC's parking facilities.
