Rules and Regulations for Conditional License Agreement to Park
Subject to the terms and conditions of the Conditional License Agreement to Park (“Agreement”) and upon issuance of a parking pass, Freshmen Lots LLC (“Company”) grants the undersigned (“Parking Tenant”) a conditional, non-exclusive license to park one (1) motor vehicle in one (1) unreserved available parking space within a Freshmen Lots LLC parking facility, in common with other licensed Parking Tenants, and in accordance with these Rules and Regulations.
This conditional license does not create a bailor-bailee relationship. Freshmen Lots LLC does not assume care, custody, or control of any vehicle or its contents.
This license is valid only for the period specified in the Agreement, is non-transferable, and is strictly non-refundable except where expressly stated by Freshmen Lots LLC in writing.
Parking Pass Issuance and Use
A parking pass will be issued once all required documentation is submitted and payment is received.
The parking pass must be clearly visible at all times while parked. Parking passes are non-transferable. Lost or misplaced passes require a $50 replacement fee.
Resale, sharing, lending, or transfer of a parking pass to any other individual without written approval from Freshmen Lots LLC is strictly prohibited.
Any pass found to be resold or used by an unauthorized individual shall be immediately null and void with no refund, and parking privileges will be permanently revoked.
Use of Parking Facilities
All facilities are self-park lots. Freshmen Lots LLC does not provide parking attendants. Any individual assisting with parking at the request of the Parking Tenant shall be deemed the agent of the Parking Tenant, and Freshmen Lots LLC shall not be liable for any resulting damage, loss, or injury.
Freshmen Lots LLC provides a limited number of parking spaces per lot and does not guarantee any specific space. Freshmen Lots LLC reserves the right to temporarily close facilities for maintenance or repairs without refund.
Prohibited Parking and Towing
Parking is permitted only in marked spaces for standard passenger vehicles. Violations subject to immediate towing at the Parking Tenant’s expense include:
• Parking outside marked spaces
• Blocking entrances, exits, traffic lanes, or other vehicles
• Parking on sidewalks, grass, or non-designated areas
• Double parking or occupying more than one space
• Parking without a valid pass
• Use of altered, duplicate, or transferred passes
• Abandoned vehicles
Any violation may result in immediate revocation of parking privileges without notice.
Outdoor Parking and Weather Conditions
All Freshmen Lots LLC parking facilities are outdoor, uncovered lots and are subject to weather conditions including snow, ice, rain, flooding, and other natural elements.
While the property owner may perform general plowing or maintenance, Freshmen Lots LLC does not control snow removal operations and makes no guarantee regarding the timing or completeness of lot clearing.
Removal of snow and ice surrounding or blocking a vehicle is the sole responsibility of the Parking Tenant.
Freshmen Lots LLC shall not be responsible for:
• Inaccessibility due to weather conditions
• Vehicles blocked by snow or ice
• Delays in plowing or clearing
• Weather-related damage or inconvenience
No refunds, credits, or extensions will be issued due to weather-related issues.
Refund Policy (Strict)
All parking passes are final sale. Freshmen Lots LLC does not issue refunds for any reason, including but not limited to:
• Weather conditions
• Changes in class format or ability to park on campus
• Inconvenience or inability to access a vehicle
• Early departure from school
• Personal circumstances
Purchase of a parking pass constitutes acknowledgment and acceptance of this strict no-refund policy.
Payment Disputes
Any Parking Tenant who initiates a credit card chargeback or payment dispute for a parking pass fee shall have their parking privileges immediately revoked.
The associated parking pass shall become null and void with no refund, and the individual will be permanently prohibited from using Freshmen Lots LLC parking facilities in the future.
Freshmen Lots LLC reserves the right to pursue collection of disputed funds and any associated fees.
Liability Disclaimer
All personal property left in vehicles is at the owner’s risk. Freshmen Lots LLC assumes no responsibility for theft, vandalism, fire, damage, loss, or personal injury of any kind. Freshmen Lots LLC does not provide security services and makes no guarantee of safety for individuals or vehicles.
Indemnification
Parking Tenant assumes all risks related to use of the parking facilities and agrees to indemnify and hold harmless Freshmen Lots LLC and its representatives from any claims, liabilities, damages, costs, and expenses (including attorney’s fees) arising from use of the facilities or violation of these Rules.
Additional Terms
• Freshmen Lots LLC is not affiliated with James Madison University
• Disruptive or abusive conduct may result in removal without refund
• Littering will result in permanent revocation of privileges without refund
